Kevin Preston and Douglas Ewen appeared in the Supreme Court, challenging the mandatory 7-year sentence handed down by the High Court, to Daniel Fitzgerald, for a kiss on the cheek. Under the three-strikes law, the courts must impose the maximum prison term available even for minor offending. Kevin and Douglas challenged the law, as breaching the New Zealand Bill of Rights Act and New Zealand's international human rights obligations. The Supreme Court has reserved its judgment.
